Terms of Service

1. Agreement to These Terms

These Terms of Service ("Terms") are a legal agreement between you and Curz Mobile Apps Solutions ("Curz", "we", "our", or "us"). They govern your download, installation, and use of every mobile application we publish on Google Play, the Apple App Store, or any other store, together with any related content, features, and services (each an "App", together the "Apps").

By downloading, installing, or using any App, you agree to these Terms. If you do not agree, do not use the App and uninstall it from your device.

2. Applications Covered

These Terms apply to all Apps published by Curz Mobile Apps Solutions, including:

  • 🌊 Aqua360
  • 📦 Inventory Management

They also apply to any future App we publish that links to this page. Where an App has additional App-specific terms or notices shown inside the App, those apply together with these Terms; if they conflict, the App-specific terms prevail for that App.

3. Eligibility & Children

You may use the Apps if you can form a binding agreement under the laws of your country, or if your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

Some Apps, such as Kids 360 and All in One Kids & Family, are designed for children. These Apps are intended to be set up and supervised by a parent or guardian, who accepts these Terms on the child's behalf. Child-directed Apps do not collect personal information from children and do not show personalized advertising. See our Privacy Policy for details.

4. License to Use the Apps

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to download and use the Apps on devices you own or control, for your personal or internal business use.

You agree that you will not:

  • Copy, modify, distribute, sell, rent, or sublicense any App or its content.
  • Reverse engineer, decompile, or disassemble any App, except where applicable law expressly permits it.
  • Remove, alter, or hide any copyright, trademark, or other proprietary notice.
  • Use any App for an unlawful, harmful, fraudulent, or abusive purpose, or to infringe anyone's rights.
  • Interfere with, disrupt, or try to gain unauthorized access to an App, its servers, or networks.
  • Use cheats, bots, exploits, or automated tools to manipulate gameplay, scores, rewards, or advertising.

If you downloaded an App from the Apple App Store, Apple's Licensed Application End User License Agreement also applies, and Apple is a third-party beneficiary of these Terms for that App.

5. Your Content

Some Apps let you create or import content, such as photos and videos in Video Creation 360, stories in StoryBuilder, documents and scans in Tools 360, or pond, farm, and stock records in Aqua360 and Inventory Management ("Your Content").

  • You keep all ownership rights in Your Content.
  • Unless an App states otherwise, Your Content is processed and stored on your device. You are responsible for backing it up.
  • You confirm that you have the rights needed to use any content you import, and that it does not break any law or infringe anyone's rights.
  • We are not responsible for loss of Your Content caused by uninstalling an App, clearing app data, device failure, or changing devices.

6. Accounts

Most Apps can be used without an account. Where an App offers an optional account or sign-in feature, you are responsible for giving accurate information, keeping your login credentials confidential, and all activity under your account. Tell us promptly if you suspect unauthorized use. You can ask us to delete your account and related data at any time by contacting us (see Section 16).

7. Purchases, Subscriptions & Virtual Items

Some Apps may offer paid features, such as ad removal, premium tools, or in-game items or currency. Where offered:

  • Payments are processed by Google Play or the Apple App Store under their own terms. We do not receive or store your payment card details.
  • Subscriptions renew automatically unless you cancel at least 24 hours before the end of the current period. You can manage or cancel subscriptions in your Google Play or App Store account settings.
  • Refunds are handled under the refund policy of the store where you made the purchase, and as required by applicable law.
  • Virtual items and in-game currency have no real-world monetary value, cannot be exchanged for cash, and are licensed to you, not sold.

Child-directed Apps place any purchase behind a parental gate.

8. Advertising

Free versions of some Apps show advertisements served by third-party networks such as Google AdMob. Ads in child-directed Apps are non-personalized and follow the Google Play Families Policies. We are not responsible for the content of third-party ads or for any products, services, or websites they promote. Any dealings you have with advertisers are solely between you and the advertiser.

9. Device Permissions

Some Apps request device permissions, such as the microphone for BlowBalloon and BlowFan, the camera for scanning in Tools 360, or photo and storage access for Video Creation 360. These permissions are used only for the feature you are using. You can grant or revoke them at any time in your device settings, but some features may not work without them.

10. Informational Content & No Professional Advice

Some Apps provide calculators, estimates, market rates, or other reference information. For example, Aqua360 provides feed calculations, water-quality guidance, and mandi (market) price information, and Inventory Management provides stock and business records. This information is provided for general guidance only:

  • It may be incomplete, delayed, or inaccurate, and it is not professional, veterinary, agricultural, financial, tax, or legal advice.
  • You should verify important information independently and use your own judgment before making business, farming, or financial decisions.
  • We are not liable for any loss, including crop, stock, livestock, or financial loss, that results from relying on such information.

Educational content in our children's Apps supports learning but does not replace parental guidance or formal education.

11. Intellectual Property

The Apps and all of their content, including software, graphics, characters, sounds, music, text, designs, logos, and the "Curz Mobile Apps Solutions" name, are owned by us or our licensors and are protected by copyright, trademark, and other intellectual property laws. Except for the limited license in Section 4, these Terms do not give you any rights to them.

If you send us feedback or suggestions, we may use them freely without any obligation to you.

12. Third-Party Services

The Apps may use or link to third-party services, such as Google Play, the Apple App Store, Google Firebase, Google AdMob, WhatsApp, or external websites. Your use of those services is governed by their own terms and privacy policies. We do not control and are not responsible for third-party services.

13. Updates, Changes & Termination

  • We may update, change, suspend, or discontinue any App or feature at any time, with or without notice. Some updates may be required to keep using an App.
  • We may suspend or end your right to use an App if you break these Terms.
  • You may stop using an App at any time by uninstalling it.
  • Sections 5, 10, 11, 14, 15, and 17 continue to apply after termination.

14. Disclaimer of Warranties

THE APPS ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APPS WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR COMPATIBLE WITH YOUR DEVICE.

Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you.

15. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, CURZ MOBILE APPS SOLUTIONS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, REVENUE, OR BUSINESS, ARISING FROM OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE APPS.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO AN APP IS LIMITED TO THE AMOUNT YOU PAID US FOR THAT APP IN THE 12 MONTHS BEFORE THE CLAIM, OR INR 1,000 (OR THE EQUIVALENT IN YOUR LOCAL CURRENCY), WHICHEVER IS GREATER.

Nothing in these Terms limits liability that cannot be limited under applicable law, or any rights you have as a consumer under the laws of your country.

16. Privacy

Your use of the Apps is also governed by our Master Privacy Policy and the App-specific privacy policy for each App. These explain what data we collect, how we use it, and the rights you have over it.

17. Governing Law & Disputes

These Terms are governed by the laws of India, without regard to conflict-of-law rules. Before starting any formal claim, please contact us so we can try to resolve the issue informally. Any dispute that we cannot resolve informally will be subject to the jurisdiction of the competent courts in India, except where the law of your country of residence gives you the right to bring a claim in your local courts.

18. Changes to These Terms

We may update these Terms from time to time. When we do, we will change the "Last Updated" date at the top of this page, and for significant changes we may also give notice in the App. If you keep using an App after changes take effect, you accept the updated Terms.

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce any provision is not a waiver of it. These Terms, together with our Privacy Policy, are the entire agreement between you and us about the Apps.
